Abstract

 


Divorce occurs due to several factors, including the influence of social media. The aim of this research is to examine the phenomenon of spreading news about domestic infidelity which is viral on social media. This research method is a normative method. The research results show that Tiktok is an option for viralizing infidelity because of easy access and users from various groups. By making household problems viral, it only satisfies for a moment and imposes social sanctions on the couple, while the negative impact of this is more numerous and long-lasting. Elements of defamation, pornography, and career and reputation become conflicts between partners. Apart from that, there is state law, if a cheating partner is proven to have committed adultery, they can be charged under Article 284 of the Criminal Code (KUHP) with a maximum sentence of nine months in prison. Article 310 paragraphs (1) and (2) of the Criminal Code explains that intentionally attacking someone's honor or good name by accusing them of something, with the clear intention of making it known to the public, is punishable for defamation by a maximum prison sentence of nine months. If this is done by means of writing or images that are broadcast, displayed or posted in public, then for written defamation they will be threatened with a maximum prison sentence of one year and four months. In Islamic law, making a partner go viral on social media brings harm both in terms of backbiting and including cases of slander.
