Abstract

Gambling in the current digital era is very difficult to eradicate, considering the effectiveness of law enforcement against online gambling crimes is quite complicated to eradicate because it is technology-based. However, in reality, it is still less than optimal because until now online gambling is still easily accessible. The application of the provisions in the old Criminal Code, articles 303 and 303 bis and articles 426 and 427 of the new Criminal Code still provide leniency to perpetrators, where gambling can still be valid if they get permission. Even in article 27 of the ITE Law, it has not been able to provide a deterrent effect on online gambling perpetrators because it is not specifically regulated on how to identify and track online gambling perpetrators. Gambling always has an effect on the brain which results in addiction to the point of forgetting oneself about the dangers of online gambling. Disturbances and pressure on the psychology of gamblers make them trapped in an illusion that provides a strong encouragement that victory will be on their side.
